Davis County Shooting Range
Waiver, Release of Liability, and Indemnity Agreement
Davis County, by and through Davis County Sheriff's Office (the “County”), operates an outdoor shooting and firearms range known as the “Davis County Shooting Range,” located at 1649 East 650 North, Kaysville, Utah (the “Shooting Range”). I understand that participation at and use of the Shooting Range can be physically and mentally stressful and dangerous, and I hereby assume all risks associated with such participation by freely, voluntarily and without duress agreeing to the following terms:
- I hereby acknowledge that I am voluntarily participating in and/or observing activities at the Shooting Range.
- I accept total responsibility for my actions. In consideration for the use of the Shooting Range, I release, waive, discharge, and covenant not to sue the County, its commissioners, officers, agents, and employees (the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising from or during my use of, or conduct on, the Shooting Range, whether caused by negligence or otherwise.
- am fully aware of the risks and hazards connected with being on the premises and participating in the Shooting Range, including unknown risks, and I voluntarily assume full responsibility for any loss, property damage, personal injury, or death that may be sustained, whether caused by the negligence of Releasees or otherwise. The County is not responsible for death or injury caused by inherent risks of using the Shooting Range.
- Prior to signing, I had the opportunity to observe the premises and obtain all relevant information and advice, including legal advice, about the nature and risks of participation.
- I agree to indemnify and hold harmless the County and the Releasees for any costs, expenses, or damages, including attorney fees, resulting from any claim arising out of my participation or observation of activities at the Shooting Range.
- This Agreement is intended to be as broad and inclusive as permitted under Utah law. If any provision is held invalid, the balance shall continue in full force and effect.
- I warrant the following statements are true and correct, and the County has relied on them in permitting my use of the Shooting Range:
- A. I am not prohibited by any federal or state law from possessing a firearm.
- B. I have no medical, psychological, or other condition that would prevent or inhibit my use of the Shooting Range.
- C. No oral statements or inducements apart from this written Agreement have been made.
- D. I am aware of the risks and hazards inherent in entering and using the Shooting Range.
- E. I accept all risks of property damage, personal injury, or death from participation or observation of range activities.
- F. I agree to comply with all rules and regulations of the Shooting Range.
- G. I am:
- 1. At least eighteen (18) years old and fully competent; or
- 2. Under eighteen (18) and at all times supervised by a parent or guardian.
- H. I have carefully read and fully understand the covenant not to sue and voluntarily sign this Agreement.
Privacy Notice
The personal information collected through this waiver form is obtained to verify your acceptance of the required liability waiver, to facilitate marketing communications, confirmation emails, and range facility updates. If you decline to provide the requested data, you will be denied entry. All information will be retained for no more than two (2) years and will not be disclosed except as required by law. Davis County Shooting Range does not sell personal data. All collected data is cataloged under Record Series: Recreation Registration Records (GRS-649).
