What is open burning?
It is the burning of any combustible materials where the products of combustion are emitted into open air without passing through a chimney or stack.
Can I burn yard waste and garbage on my property?
The Davis County Open Burning Regulation and the Utah Administrative Code R307-202 do not allow the burning of trash, garbage, waste (including yard waste), or hazardous materials in any open fire.
What is agricultural burning?
It is an open burning of orchard pruning, field stubble, and weeds. To meet the requirements of an agricultural burning, the property must have a minimum of two (2) acres for agricultural use, or be an orchard of 25 or more fruit/nut trees.
Do I need a permit for agricultural burnings in Davis County?
Notification must be made to the local Municipal Fire Authority for the agricultural property prior to conducting any Agricultural or Horticultural burning. These burnings must also comply with city ordinances.
Can I have a fire pit (recreational fire) in my private yard?
Unpermitted open burning is allowed under the following conditions (unless prohibited by city ordinance):
o In devices for food preparation;
o Recreational fires (i.e. pit fire);
o Indoor fireplaces and stoves;
o Industrial flares.
Can I conduct an open burning regardless of the Air Clearing Index?
All action days as reported through the State Division of Air Quality (DAQ) apply to open burning. Burnings may not occur on “Restricted” action days and are advised against during “Voluntary” action days. The Clearing Index must be above 500 for an agricultural burn to be considered.
What is the air Clearing Index?
The Clearing Index is an Air Quality/Smoke Dispersal Index used to regulate open burning and as input for other air quality decisions throughout Utah. The Clearing Index is defined as the Mixing Depth (depth of the mixed layer in 100s of feet above ground level) multiplied by the Transport Wind (average wind in the mixed layer in knots). Clearing Index values below 500 are considered poor ventilation and open burning is restricted under these conditions. Any Clearing Index values above 1000 are considered excellent ventilation and are referred to as 1000+.
