Body art is any body piercing, tattooing, permanent makeup, microblading, branding, and scarification.
Any facilities conducting body piercing, tattooing, permanent makeup, branding, or scarification need to obtain a Davis County Body Art Facility Permit. This does not include ear piercing as defined in Utah Administrative Code R392-701 Body Art Facility Sanitation.
Starting a Body Art Facility
The first step in obtaining a permit is to complete a Body Art Facility Permit application. The application includes submitting plans of the facility. The facility must conform to the Utah Administrative Code R392-701 Body Art Facility Sanitation and the Davis County Board of Health Body Art Regulation. Proof of current certifications for bloodborne pathogen and first aid training must also be submitted for each artist that will be operating at the facility. A plan review fee will be charged ($250) when submitting the application. After plans have been approved and construction has been completed, the facility must schedule and pass a pre-opening inspection. The permit fee ($200) must be paid prior to the permit being issued.
Bloodborne Pathogen Training Certificate
The certificate for bloodborne pathogen training must come from a program that covers each element of OSHA's Bloodborne Pathogens Standard as described in 29 CFR 1910.1030 (2024).
First Aid Training Certificate
The certificate for first aid training must come from a program, such as AHA Heart Saver First Aid, that teaches first aid basics for the most common first aid emergencies.
Temporary Body Art Facility
A Temporary Body Art Facility is a body art facility that is operating at a fixed location where a body artist performs body art procedures for no more than 14 consecutive days in conjunction with a single event or celebration.
The first step in obtaining a permit is to complete a Temporary Body Art Facility Application. Applications must be submitted 14 days prior to operation. Once the application and plans are approved and the permit fee ($100) has been paid, the permit can be issued. Temporary Body Art Facilities are limited to four artists per permit.
Temporary Body Art Event
A permit for a Temporary Body Event must be obtained for any public or private event in which four or more Temporary Body Art Facility Permits are issued. An application must be submitted 30 days prior to the start of the event. A permit fee ($250) must also be paid prior to the issuance of the permit.
