Food establishments that are in operation for only the warmer months (April – October) of each year are categorized as Seasonal Food Establishments. These include food establishments at amusement parks, baseball fields and Flavored Ice Establishments.
With the exception of Flavored Ice Establishments, Seasonal Food Establishments must meet all requirements of a regular Food Establishment that operates on an annual basis.
A Flavored Ice Establishment is a Seasonal Food Establishment with a restricted menu. The food items that may be offered from this type of establishment are limited to ice, syrup, single serve ice cream, and sweetened condensed milk. Other non-TCS (food requiring Temperature Control for Safety) toppings, such as candy or fruit, may be used with approval from the Health Department.
Flavored Ice Establishment permits can be obtained by completing a Flavored Ice Establishment application, submitting plans, and paying the applicable fees. After the plans have been approved and the establishment is ready to operate, a pre-opening inspection must be scheduled. If the establishment is found to be compliant with all of the requirements, a permit to operate will be issued.
The permit prices are also dependent on the risk categorization of the establishment. A Risk I Seasonal Food Establishment is an establishment that does not prepare, store, or serve any raw meat; nor do they prepare, store, or serve more than two (3) TCS foods (Foods requiring Temperature Control for Safety).
